European Court of arbitration

At a technical meeting of the Lexteam on Saturday 11 October 2014, Jochen Bauerreis gave a lecture on the following topic:

The European Court of Arbitration in Strasbourg : an interesting alternative for arbitration in France

During his lecture Jochen Bauerreis set out the various advantages of the European Court of Arbitration for domestic and international arbitration in France:

  • Choice of the arbitrator by the parties who are assisted in this regard during the preliminary meeting,
  • Appointment of a sole arbitrator (unless the parties request the appointment of three arbitrators)
  • A time limit of 9 months for issuing an arbitral award,
  • The very moderate costs and the reduction in arbitration costs arising from the appointment of a sole arbitrator instead of three
  • Request that the arbitrator draw up a procedural timetable
  • Constitution of specialised sections in different fields
  • The existence of a potential appellate arbitral division which must issue its decision within 12 months
